The theory of siyasa shar'iyya, statecraft in accordance with the shari'a, which was developed by Ibn Taymiyya (1328 CE) and further elaborated by his pupil Ibn Qayyim al-Jawziyya (1350CE) had a great impact on Ottoman legal and political theory and was the starting point for Islamic legal and political thinkers. The decision to constitutionalize Islamic law in late twentieth-century Egypt represents a commitment to the idea that state law must be a modern analogue of siyasa shar'iyya.

Siyasa literally means ‘statecraft’ or ‘governance.’ The promulgation of rules, the selection of rules of decision for courts and the decision to enforce a particular legal norm all fall under the rubric of siyasa. A ruler’s policies and governmental actions (his siyasa) might naturally be based on non-Islamic considerations. Shar'iyya is the adjectival form of shari'ah describes something that is related to or consistent with the shari'a. Siyasa shar'iyya thus means ‘governance (including legislation and adjudication) in conformity with the shari'a.'

@Ahmad Al Segari, religious Jews continue to practice Rabbinic law which is based on Torah law. However except for family law it is voluntary, and the state often tries to reduce it to strictly ceremonial purposes. The issues of halachah and shari'ah in a modern state are very much the same.

Ahmad Al Segari - the Torah punishment for adultary is stoning however the oral law which is similar to the hadith made the punishment only applicable with two qualified witnesses who warned the woman beforehand so in practice the capital punishment was rarely carried out. Nowadays there is not a Jewish (halachic) court with the power to give the death penalty.

@Dan Jacobs, We must be careful when comparing systems, even concepts as fundamental as "law" and "punishment" which today are largely understood in terms of Roman civil law and its derivatives, differ in certain ways from their Rabbinic or Islamic counterparts.

the problem with Muslim countries nowadays , are only by name , they do not practice Islam , they are called Muslim country , but they are ruled by laws of men , there are different between culture, traditions and man laws in one side and religions laws in another side, many if not most of Muslim countries are ruled by tradition and culture more than religion , this why Muslim countries are backward countries because of traditions and culture not religion , go back to the history when Muslims countries ruled by Islam teaching and make comparison, and you find Muslim countries becomes backward after they left the teaching of Islam

Well, sharia law as it materializes in practice, in a legal system is done with human judgment. Humans look at the sources, try to figure out what the law is and then create a system. It also involves a human interpretation as to what that even means. ie a method for interpreting it.

As a legal system, it is created through human interpretation of the Islamic sources. This also involves a human interpretation of even if it is to be enforced or not. It's a little bit more complicated than saying "We need to follow the Shariah". Shariah itself is God's law. God's law in the Muslim community has always gone through human interpretation in application in even deciding what is following the law or not.

Ben Abrahamson: Here is a picture of that same area in 2014. There have been thousands of houses built in this area. The Dome of the Rock and Masjid Al Aqsa is on the left. The Mount of Olives, Jewish cemetery is the white space in the lower half of the picture. The green area above the cemetery is the Garden of Gethsemane. The cemetery has been destroyed and built over in many places. The Road "Derekh Yerikho" was built through the middle of the cemetery by Jordan in 1967 when it controlled the area. The houses of the At-Tor neighborhood on the eastern side are slowly encroaching.

Ben Abrahamson : I do not know the details of the case that you describe here. Unlike good journalism, the article does not give the other side a chance to defend themselves. Nor does the article give context, history, or legal information, or even a street address. From the picture in the article it can be seen that the house was built on the edge of the right hand side of the Mount of Olives cemetery. It would be sad, but not surprising that it was not given a permit. If it was built anyway against municipal orders it would be destroyed.

This is not a common occurrence, unlike what the article implies. About 250,000 people have built houses and live in East Jerusalem.

Ben Abrahamson:  For two generations we have suffered wartime propaganda. Each side in the Middle East tries to demonize the other, making them less than human. This is being done by the secular non-religious and sometimes anti-religious media. They benefit when believers fight against each other. We need religious judges, who fear God more than politics or the media, to call witnesses, examine facts, and come to a true conclusion. We cannot rely on the TV to bring us a balanced view of the truth.

How can one know what is a "fact" without a proper trial, with God-fearing justices? How many religious courts have ruled on this? Where are the verdicts of religious, God fearing courts who have call witnesses, examine

facts, and come to a true conclusion? 

A proper Muslim, and a proper Jew, is forbidden by religious law to go to a non-religious court. How much more so, to decide something based on what amounts to - by religious law - gossip. Verdicts of guilty or innocent must be issued by judges, not journalists.

ঐশ্বরীক গ্রন্থের প্রতি অশ্রদ্ধা প্রদর্শন করা অনুচিত। নিখিল সৃষ্টির শান্তি-শৃংখলার সনদ ঐশ্বরীক গ্রন্থ। আমি তোমাদেরকে সাবধান করছি। ইয়াযিদ সর্বপ্রথম ক্ষমতার লোভে মুসলিম ইতিহাসকে কলংকিত করেছে। আমরা বর্তমানে ধ্বংসের দ্বার প্রান্তে উপনীত। আর আগাইও না, দাজ্জালের প্রিয়ড চলছে, আল্লাহ তোমাদের সত্য উপলব্ধি করতঃ তাঁহার পথে চলার তৌফিক দান করুন।

প্রাণীগণ জন্মগতভাবে বিদ্যাসম্রাট। জন্মগতভাবেই সকল প্রাণী বৈষয়িক জ্ঞানের অধিকারী – তা না হলে প্রাণীজগতের অস্তিত্বই রক্ষা পেত না। জন্মগতভাবে আল্লাহ রাব্বুল আলামীন ৫টি জ্ঞান ইন্দ্রীয় প্রদান করেছেন। অর্থাৎ আমরা সবাই আল্লহর কুদরতের হাতে অবস্থান করছি। এটাই জন্মগত বা পাশবিক জ্ঞান। অতএব আল্লাহ আমার রব। রব-ই আমার সব।

বাগুচি মাদ্রাসা, মাধাইয়া, চান্দিনা, কুমিল্লা।

সুফী ও মোহাক্কেকীনরা বান্দাকে আল্লাহর সাথে জোড়েন, আল্লাহর অনুগত করেন।

অদ্য আমাদের এক নামকরা সাংবাদিক বন্ধু ফোন করে একজন ৭৮ বছর বয়স্ক দেওবন্দী আলেমকে পাঠিয়েছিলেন – যিনি শিক্ষাজীবনে পীরজী হুজুর (রঃ)এর প্রিয় ছাত্র ছিলেন।  তিনি বললেনঃ

সুফীরা আল্লাহর প্রেমে প্রেমাসক্ত করে বান্দাকে আল্লাহর সাথে জুড়ে দেন।

মোহাক্কেকীনরা আল্লাহর বিধানের যৌক্তিকতায় সন্তুষ্ট করে বান্দাকে আল্লাহর গোলামীর পথে পরিচালিত করেন।

মেটেরিয়ালিজম খতম করে পাওয়ারিজম (সর্বশক্তিমানের উপর ভরসা) কায়েম না হলে মানব জাতি ধ্বংসাত্মক পথ থেকে বাঁচবে না।

তাই পেট সর্বস্ববাদ খতম করে মানববাদ তথা একত্ত্ববাদ কায়েম করার সংগ্রাম।

ইয়াযিদি ইসলাম বর্জন করে হযরত হোসাইন (রাঃ)এর ঝান্ডা না ধরলে উম্মত ধ্বংস থেকে উদ্ধার পাবে না।

সংবিধান প্রনয়ন করা সাধারণ মানুষের কাজ নহে; ইহা অতিমানব বা মহামানবের কাজ। এই বাস্তব সত্য না বুঝিয়া হীন স্বার্থ চরিতার্থ করিবার জন্য ধর্ম ও রাজনীতির নামে স্বজাতিকে টুকরা টুকরা বিভক্ত করিয়া জাতীয় অস্তিত্ব বিলুপ্ত করা হয়।

শিক্ষা নিরাকার অলৌকিক। ... শিক্ষা, বিদ্যা, বাকশক্তি, শ্রবনশক্তি – এ সকল ছোট ছোট শক্তিগুলি মহাশক্তির নিয়ন্ত্রনে। বর্তমান বিশ্বে শিক্ষা শব্দটি ভুল অর্থে ব্যবহার করা হইতেছে।

অল্পে তুষ্টি ও সর্বদা আল্লাহর পবিত্র নামের জিকিরের রসের দ্বারা জিহ্বাকে সিক্ত রাখি।

উল্লেখিত মুরুব্বীর নাম ঠিকানাঃ

মওলানা আব্দুর রহমান ফারুকী (৭৮),

শিক্ষা শুদ্ধি অভিযান,

উম্মতের ঐক্যবদ্ধ থাকার কৌশল - মতপার্থক্য সত্বেও ছবর এখতিয়ার করার নির্দেশ (পবিত্র ক্বোরাণ, সুরা আনফাল, আয়াত নং-৪৬)

পবিত্র ক্বোরাণ, সুরা আনফাল, (আয়াত নং-৪৬)

আর আল্লাহর নির্দেশ মান্য কর, আর তাঁর রাছুলের।

তাছাড়া তোমরা পরস্পর বিবাদে লিপ্ত হইও না।

যদি তা কর (অর্থাৎ যদি বিবাদে লিপ্ত হও), তবে তোমরা কাপুরুষ হয়ে পড়বে এবং তোমাদের প্রভাব চলে যাবে।

আর তোমরা ধৈর্য ধারণ কর।

নিশ্চয়ই আল্লাহ রয়েছেন ধৈর্যশীলদের সাথে।

তফছীর, হযরত মুফতি মুহাম্মদ শাফী (রঃ), তফছীরে মারেফুল ক্বোরানঃ-

এক্ষেত্রে ক্বোরাণে করীম ‘ওয়ালা তানাজাঊ’ বলেছে। অর্থাৎ পারস্পরিক বিবাদ-দ্বন্দ্ব থেকে বিরত করেছে, মতের পার্থক্য কিংবা তা প্রকাশ করতে বাধা দেয়নি।

যে ক্ষেত্রে মতপার্থক্যের সাথে সাথে নিজের মত অন্যকে মানাবার প্রেরণা কার্যকর থাকে তাকেই বলা হয় বিবাদ ও বিসংবাদ।

আর এটিই হল সে প্রেরণা যাকে ক্বোরাণ করীম – ‘ওয়াছবেরু’ শব্দে ব্যক্ত করেছে এবং সবশেষে ‘ছবর’ অবলম্বনের এক বিরাট উপকারিতার কথা বলে এর তিক্ততা দূর করে দিয়েছে যে, ‘ইন্নাল্লাহা মা আস ছবেরীন’ (যারা ছবর তথা ধৈর্য ধারণ করে আল্লাহ তাদের সংগে রয়েছেন।)

Shrine of the Cloak (Kherqa) of Holy Prophet Muhammad (SAWS)

Location  :  Kandahar, Afghanistan

The Shrine of the Cloak (Pashto: Kerqa Sharif) is located adjacent to the main mosque in Kandahar, Afghanistan. It contains the Kherqa, a cloak believed to have been worn by Islam's Prophet Muhammad (Blessings of Allah be upon him).

The cloak was last seen in public in 1996, when Mullah Muhammad Omar, the leader of the Taliban, removed it from the shrine and donned the cloak while he stood atop a building, and in front of a large crowd of his followers.  Upon donning the cloak, the crowd began to shout "Amir al-Mu'minin" (Commander of the Faithful).

 That symbolic act is commonly considered a key point in the rise of the Taliban.

Hefazot-e-Islam, Bangladesh : An Introduction by Hefazot Leaders

In the name of most merciful Allah who is the God of Prophet Muhammad (Peace be upon him), Prophet Issa (Jesus)(Peace be upon him) and all other prophets.

When he was studying at Darul Uloom Deoband, India, Allama HOSSAIN AHMAD MADANI, the Chief Leader of Indian Freedom Movement was Head of Hadith [The Sayings of Prophet Mohammad (Peace be upon him)] department of “Daurl Uloom, Deoband”, India- the largest Islamic University in Asia. Two Indian Freedom Movement leaders, M.K. Ghandi and J.L. Neheru were his close friends. Allama MADANI formed the “Jamiate Olama-e Hind” with his teacher “MAHMUDUL HASSAN DEOBANDI”. Then, this Organization in collaboration with M.K. Ghandi and J.L. Neheru played a historical role for the freedom movement of India. Because of this reason, the CONGRESS PARTY in INDIA is in power for two-third times in the last 60 years by the support of millions of Muslim voters in India, those who are the followers of “Jamiate Olama-e Hind”.

To understand about the unbeatable spiritual power of HEFAZOT-E-ISLAM and his leader Allama Ahmad Shafi, we must understand the source of the oldest and largest Madrasa in Hathazari, Bangladesh and above 50 thousands Madrasas of India and above 60 thousand Madrasa of Bangladesh and Pakistan and around 10 thousands Madrasas of USA, EUROPE, AUSTRALIA & SOUTH AFRICA – in Total approximately 150 thousands of non-Government Deobandi Quami Madrasas around the world. Maulana Nanutovi and founder of Ali-Ghar Islamic University, Sir. Sayed Ahmed Khan were student of the same teacher, Maulana Mamluk Ali.

After the completion of all kinds of Islamic knowledge, Maulana Nanutovi became a efficient debater. The Hindu pandits and Christian scholars were not been able to withstand in front of the logics and magnificent orating capability of Maulana Nanutovi. His counterpart of various religion were defeated in various occasions. The scope of knowledge, skill and logic spread in Hindu, Buddhist, Christian and Muslim community of that time.

Because of the Anti-British movement, the British Government announced the arrest of Maulana Nanutovi for several times. But, the Government were never been able to arrest him. But, he never hid himself more than three days. Once an incident took place which is as following:

Once, he went to his father-in-laws home in the request of his friends and relatives. He stayed there for three days. After this time, when he came out, he fell in front of the people of Intelligence agency. He asked the people: “What do you want?”. They said: “We have come to search Maulana Qasim Nanutovi”. Maulana Nanutovi said: “Please come, come to home”. He then adored all of them as guests.  After that, he asked the people of Intelligence: “Where do you want to search Maulana Qasim Nanutovi?” They said that they would like to search in the rooms of women. Maulana Qasim Nanutovi took them to the rooms for searching.

This is Maulana Qasim Nanutovi who showed them the rooms, but people of intelligence were not been able to recognize him.

Was Maulana Qasim Nanutovi a magician? NO, NEVER. Then, what is the power that he had for what the intelligence were not able to recognize him. He had the power of Spirit.

Another incident regarding Maulana Qasim Nanutovi took during the battle named “Shamoli”  between British arm force and Indian patriots. In this battle, Maulana Qasim was shot in his head by the British force. He fell down. All of his fellows went running to him and found his clothes were full of bloods. But, his fellows did not find any sign of blood and bullet in his head. When he was asked regarding the matter, he said: “I recited Bismillah and wiped spit in the place of wound, then miraculously the wound got fully cured”.

The incidents of Maulana Qasim Nanutovi are not fantasy, but these are the expressions of the spiritual power that he had.  He is the founder of “Daurl Uloom, Deoband”, India.

(a)    His established “Daurl Uloom, Deoband”, India which is the source of approximately 150 thousands Qaumi Madrasas and 10 millions of students throughout the world.

(b)   One Ex-student student of his established “Daurl Uloom, Deoband”, India is Maulana Md. Iliyas who is the founder of “Tabligh Jamat”- the largest missionary organization for preaching Islam. Under this Organization, more the 700 million Muslims are involved in preaching activities in rural and urban areas of the world. A massive numbers of Christians brothers and sisters are becoming Muslims under the “Tabligh Jamat”.

Again, most of the countries in European Union have Christian based national infrastructure. Another highly developed country, Australia believe in Christianity as national religion. So, we Muslims and Christians of America, Europe and Australia – all together a population of more the 2500 millions believe in Allah/God/Creator. We, more than 1000 millions of Muslims believe Prophet Muhammad (Peace Be upon Him) as the greatest and last prophet in the chain of prophet hood. You believe Prophet Issa/Jesus (Peace Be upon Him) as prophet. We, Muslims believe the Holy Qu’ran as divine book, where as You, Christians believe the Holy Bible as divine book.

A Muslim, after believing Prophet Muhammad (Peace Be upon Him),  can not be a Muslim anymore if he/she doesn’t believe Prophet Issa/Jesus (Peace Be upon Him) as prophet. In this respect, God, Prophet and the revealed divine books, we are all staying in the same center. The way the Atheist Bloggers of Shahbagh criticized Allah, his messenger Prophet Muhammad (Peace be Upon Him) and sacred Islam religion, if they have criticized one part of a thousand parts with the Prophet and religion of America, Europe, Australia and even the Hindu population of Indian Sub-continent then would any of the Christian and Hindu community tolerate such a massive insult and misbehave with religion?

The chief of Hefazat-e-Islam, Allama Ahmad Shafi asked several times the Government to stop the criticizings, insult, evil comments regarding  Prophet Muhammad (Peace Be upon Him), Islam by these evil, atheist Bloggers of Shahbagh. But, the Government did not listen to this and did not take any steps to stop it. At last, Hefazat-e-Islam compelled to announce to activities to stop the Atheist Bloggers of Shahbagh. And, thousands of top level Scholars, Leaders agreed to announce a historical LONG-MARCH to capital Dhaka on 6^th of April, 2013. You, including the national and international media have already known that even after striking and blocking the Roadways, Railways, Waterways and  Airways how millions of leaders and activists of “Hefazat-e-Islam” did the peaceful demonstration at “SHAPLA CHATTAR”  by walking hundreds of miles and came back peacefully after the demonstration. After that, many Gatherings and Conference took place regarding the insult, evil comments regarding  Prophet Muhammad (Peace Be upon Him), Islam and demanded the punishment of the atheist Bloggers. The Government did not listen to any these demand. After that, the “5^th May,2013 Dhaka Blockade” activity arose. The national and international media throughout the whole world have observed how the Peaceful Demonstration was proceeding at the Six gates of Entry to Dhaka.

You must have heard that the Chief of “HEFAZAT-E-ISLAM”, Allama Ahmad Shafi decided to unite all the leaders and followers of “HEFAZAT-E-ISLAM” and to give the finishing speech at “SHAPLA CHATTAR”after the peaceful demonstration with the permission of Government. Then the General Secretary of Awami League, L.G.R.D minister Syed Ashraf asked the activists of his party in a deceiving way to stop the peaceful demonstration and gathering. As a result, centering the the Awami League office at the South gate of Baitul Mukarram mosque, the armed cadres and miscreants of Awami League, Chatra League and Jubo League in association with Police force jumped over the leaders and followers of  “HEFAZAT-E-ISLAM” ruthlessly and started killing the innocent the Schloars, Leaders and activist of “HEFAZAT-E-ISLAM”. Even after asking the Government for a proper investigation regarding the burning of Islamic books at the South gate of Baitul Mukarram through the video footage and identifying the miscreant  several times, the Government did not listen to it. The Government inversely   blamed “HEFAZAT-E-ISLAM” for the activities which is absolutely absurd. The people who have spent their whole life for learning, practicing and preaching Islam, they would never be able to burn the Islamic books. Every citizen of Bangladesh understands    this fact.

After that, a historical Mass murder or Genocide took place at 2:30 a.m. on the night of the passing day, 5^th May, 2013. From record, One hundred fifty thousands bullets and  all types of heavy weapons which are used in the war field were used for attacking the sleeping Leaders and activist of “HEFAZAT-E-ISLAM”. All these operation were executed by removing the people of Media and switching off the electricity lines around “SHAPLA CHATTAR”. The number of people of  “HEFAZAT-E-ISLAM” died at that night is huge and uncountable. We asked the Government for a proper and neutral Justice & Investigation body for the mass killing several times. The Government has again stepped in the inverse direction and blaming the Leaders and Activists of “HEFAZAT-E-ISLAM” with false allegations and cases and pursuing a false propaganda in nation and abroad.

The leaders and activist of “HEFAZAT-E-ISLAM” at “SHAPLA CHATTAR” were not armed with any types of weapon. Their weapon was the spirit and remembrance of Allah at that night. Today, the Government is wrongly blaming and trying to create a portrait  of  “HEFAZAT-E-ISLAM” as a Terrorist Organization. The Government is doing such activities keeping in mind to be politically benefited in the 10^th National Election.

In all the areas of Bangladesh, the leaders and activist of “HEFAZAT-E-ISLAM” are very innocent and peace-loving. We firmly wish and expect that for these unethical activities of the Government, when 90% of the population of Bangladesh are angry on the Awami League Government, then You and all other foreign aid bodies would not be badly influence with their false broadcasting.

At present, in the unpeaceful world, the time has come for the MUSLIM UMMAH and CHRISTIAN WORLD to work together. In the holy book of Islam, the Qur’an , there are several verses and chapter praising the Prophet Jesus (PBUH) and his clean image mother Marry. We, Muslims believe the re-arrival of  Prophet Jesus (PBUH) with the light of the Qur’an. In the Chapter Al-Imran of the holy book Qur’an, Allah has taken the promise from all the prophets to obey Prophet Muhammad (PBUH). To attain the situation, Prophet Jesus (PBUH) including all the Muslims will give the invitation to accept Islam to all the Christian community all over the world. Then, in the light of Verse no:59 of Chapter:Nisa, under the realm of Prophet Jesus (PBUH), all the Christian community would accept Islam as religion. When the hints of working the Muslim Ummah and Christian community together are found in the holy books, then we the Muslim Ummah and Christian community should work together avoiding all the misunderstandings and to reach solution to maintain the peace all over the world.
